九位中国在读传媒硕士生在MONASH UNIVERSITY受到老师不公待遇

一年前,我们信心满怀地来到这个陌生的国家,却从未料到会在这受到老师的歧视和不公待遇。我们曾经向学校投诉过,可是学校没有给我们解决实质性问题。幸运的是,我们的一份投向“神州学人”和“人民日报”海外版的新闻引起了中国驻墨而本领事馆的高度关心和重视。现在,受到领馆的支持,以及一位RMIT教授的指导,我们已经正式向学校起诉这位老师。同时,我们还受到MONASH中国学生会的大力支持,如果,学校不采纳我们的意见和合理要求,我们将发动所有MONASH中国留学生全体罢课。另外,墨本市亚洲事物部部长也对我们的行为表示支持。此次事件将做成专题节目在SBS电台播出。

以下是我们递交的申诉信原文。

Reference: Complaint against discrimination

Dear Mr. Vice Chancellor and Dean of Arts faculty:

This letter is written with the intent to represent the nine Chinese international students who are currently studying Masters of Communications and Media Studies in Faculty of Arts at Monash University.

The sole intention of the following letter is to notify Monash University of an instance of unacceptable discriminatory behavior displayed by Mr. Richard Evans, who is presently lecturing on the subject of “Media, Ethics and Practice”. His discriminatory remarks and actions towards us as individuals from a Chinese background seriously hurt our feelings as being international students, and we believe are a serious contravention of the international spirit otherwise showed at Monash University.

The reasoning behind our letter of complaint is listed below:

1. Unjustified assignment results
 There are about 25 students in the class, and 8 of them failed, which means almost one third of the students failed in the second paper. The rate was so high that we had to doubt the fairness or the assessment criteria, however,
 According to the assessment criteria from Monash officials:
“An N (Fail) grade indicates that a student has failed to present evidence of an acceptable level of knowledge or understanding the area in question, has seriously misunderstood the requirements of the paper or has not submitted some element of the assessment criteria”
Regardless of our knowledge of this discipline, our paper revolved around the topic accurately. At the very least, we did not “misunderstand the requirements of the paper”.
 Some of us were entitled HD and D grade in the previous subjects, and those lecturers highly evaluate our paper. Their comments were “a wide range of reading has been used productively”, “the standard of presentation is also high”, and “this is a very good all-round performance”. Besides, most of our paper was marked at least Credit in the previous subjects. (Attachment, pp. 8-13)

2. Racial discrimination
 We believe that the assignment results are the best demonstration of this kind of racial discrimination. There are about 25 students in our class; nine of them come from China mainland. Eight Chinese students were entitled Provisional Pass (at the same mark 50%) in the first assignment. (Attachment, p.1) With regards to the second assignment, seven Chinese students were failed (marked from 30% to 48%). Besides Chinese students, the only one who failed in second assignment is an Indonesian student. On the contrary, our results of the final essay in the previous subject “Writing and Research Australia” were HD, D or C. Surprisingly, the only three Chinese student who was taught by Mr. Evans in the last semester was facing the same situation with us.
 Mr. Evans explained that the main reason he failed us due to our poor English expression. As far as we know, Monash University is one of the most international institutions in Australia and encourages students to be creative, and to overcome language barriers. Therefore, language capability should not be the primary focus of our assessment. As what presented before, our results were satisfactory in the previous subjects. On the assessment sheets from last semester, our written expressions were marked Satisfactory or Good.
 Mr. Evans also remarked that “I wish you could write in Chinese, but it’s Australia”.

3. Personal discrimination
 Mr. Evans said on more than one occasion to our group of Chinese students “You are lower than high school level” and “You are not qualified to study a master’s degree”. However six of us graduated from the English Language Bridging Program in Monash Language Centre and we believe that we were entitled to continue to master degree by Monash authority.


4. Abuse of power
 In the first assignment comments, Mr. Evans wrote: “I will not be able to pass any further assignments”. An obvious threat. (Attachment, pp.2-4)
 After receiving results of the first assignment, we went to postgraduate administrator to report the unfairness of the results and request double marking. But we were astonished by the results of the second assignment because seven of us failed, despite having made more efforts than the first assignment. We believe that the real reason for our failures was the revenge on our complaint.
 One Chinese student had given him the draft for some suggestions. He replied that the essay was in a reasonable shape and did not indicate any serious corrections. But the student still failed. (Attachment, pp.5-6)

5. Irresponsible attitude
 There was no correction of our papers for the first assignment.
 Mr. Evan claimed several times that he had no time to correct our essays because he has family to take care of when we request more details about our mistakes.
 When requested by students for some help on our English expression, he said he could do nothing for us because he is employed only to lecture. He also claimed that he is only paid for time class and is not paid for time beyond class.
 One Chinese student’s assignment was even scribbled upon by Mr. Evans’ three-year old daughter. Further highlighting the unprofessional manner in which Mr. Evans viewed our paper. (Attachment, p.7)

6. Disparaging remarks made in regards to China’s political regime
 Mr. Evans on occasions made disparaging remarks about China’s political regime in class. All of the Chinese students acknowledged that his words show a distinct lack of respect of our nation. We respect the right of free speech and would be happy to discuss the sensitive issues in China with anybody, including Mr Evans, in a fair and open manner. However, Mr. Evan frequently dispraises those issues in a condescending attitude during the class. The unnecessarily high frequency and acid tone clearly prove his enjoyment in exhibiting his superiority to nine embarrassed Chinese students sitting before him.
 He argued that China is a country in which journalists would be put in prison if they are not be careful with what they said.
 He said he could find nothing about China’s media law, as if it was non existent.
 He also commented upon Chinese politics whilst in class. He denies the validity of Chinese elections.

According to the reasoning listed above, our small group of students certainly believes we were NOT treated in a fair, respected, rational and appropriate way.

Therefore, we have to report this serous discrimination that has happened on our group Chinese students to our Chinese government authority -- the Education Division of Consulate General in Melbourne of People’s Republic of CHINA. And also we declare we need appropriate treatment in Monash University and strongly require followings:
1. Dismiss and replace the lecturer Mr. Richard Evans of the subject immediately.
2. We request our previous papers be reviewed and re-marked by at least two staff.
3. Where possible, a written apology from Mr. Richard Evans for his inappropriate attacks and behaviour.
4. We request faculty pass because of special consideration.
5. We expect to be replied as soon as possible, if possible, to be contacted in three days.

We are hopeful of a pleasant response to this problem as soon as possible. As a group we believe the actions previously described are solely attributable to the individual and that without a doubt Monash has been making efforts to form a fair, justified and free learning environment for all students including those of us studying abroad.
