A Silicon Valley real estate developer and restaurant owner was stabbed to death Tuesday morning in his Saratoga townhouse, and authorities quickly arrested his suspected killer, a suicidal woman who was free on bail from an earlier alleged attack on him.
As deputies rushed inside the townhome and found the body of Birk S. McCandless, 57, owner of McCandless Cos. and Birk's Restaurant, others tried to calm Nan Yang, 27, of San Jose, who was armed with a knife and straddling a rail on the third-floor balcony of McCandless' Fieldstone Drive townhome.
"She kept cutting herself while deputies were negotiating with her to come down," said Terrance Helm, a spokesman for the Santa Clara County sheriff's office. "They said she was very incoherent. That was probably due to the blood loss."
She eventually passed out after stabbing herself in the throat, neck and wrist, and she was taken into custody, authorities said.
McCandless had developed and managed more than 5 million square feet of office and research and development space over the past 27 years, according to his company's Web site. His business empire included property management and investment advice for high-tech companies, and his tony Birk's steak house in Santa Clara is a popular Silicon Valley meeting place.
His projects include the McCandless Technology Park, the Greylands Office Park, which was sold to EBay for its headquarters, and the San Thomas Office Park.
"We've just received and are stunned by the news of Birk McCandless' death and the related circumstances," Executive Vice President Carol Anderson of McCandless Cos. said in a written statement. "He was a wonderful boss, friend and loving father of three children. His family, friends and co-workers are struggling with this terrible loss."
Deputies were summoned to 14671 Fieldstone Drive just after 10 a.m. Tuesday by a neighbor who heard a man, identified later as McCandless, cry out for someone to call 911, Helm said.
Neighbor Melanie Scates said she had been taking her dogs out when she heard deputies trying to stop a woman from leaping. "They were shouting, 'Put down the knife! Don't jump!' '' Scates said. She saw the woman, whose face was covered in blood from cutting herself, at the railing. Yang was taken to Santa Clara Valley Medical Center in San Jose. Helm said her injuries were severe, but she is expected to live.
Yang was arrested in January on charges that she cut and assaulted McCandless, authorities said. She was allowed to post $50,000 bail and given a court order that she stay away from McCandless. She was due back in court on March 28.
"The reality is today we have a domestic violence murder by a suspect who was out on bail for a prior domestic violence incident with the same victim,'' said Santa Clara Assistant District Attorney Karyn Sununu.
Yang was already under suspicion in another stabbing. Last March, Yang allegedly stabbed a man in Sunnyvale, but the case was dropped in June after the alleged victim went back to Japan, prosecutors said.
It is unclear how Yang, a Chinese-born De Anza College nursing student, met one of the Silicon Valley's largest developers.
Authorities said they first had learned of the couple in January, when deputies found McCandless on a neighbor's porch, bleeding from the head and arms.
"She cut him very badly with a flashlight -- he was bonked in the head,'' Sununu said.
It was just after midnight on Jan. 7, and he first told officers that Yang had hit him on the head, according to the police report. McCandless refused to cooperate further.
"He was uncooperative from the beginning,'' said supervising deputy district attorney Rolanda Pierre-Dixon.
Investigators later learned that on Jan. 6, Yang had come to the townhouse and slit her wrists with a knife. McCandless did not call 911, but a relative took her to the hospital. She returned and allegedly attacked McCandless with the flashlight.
At 2 a.m. on Jan. 7, authorities located Yang, who admitted she had been in a fight with a man she said was her boyfriend.
Authorities said that Yang claimed that McCandless had promised to marry her and changed his mind. Depressed, she tried to kill herself and had asked a friend for the best way to commit suicide.
She mentioned she had been in custody before.
In fact, Yang allegedly stabbed a 22-year-old Tetsuyta Ogi of Sunnyvale a year ago. Ogi told police they had been dating two months after meeting at De Anza. She was too possessive, he said, so he broke it off.
After repeatedly coming to his home at all hours, she eventually confronted him during the day on March 22, 2004, threatened to kill him and lunged at him with a knife.
She was arrested and posted $100,000 bail. In June 2004, the charges were dropped when the alleged victim went to Japan.
"He took off, and we are not able to prosecute,'' Sununu said. "You bet we are going to be looking for him now.''
Yang's sister, who did not want to be identified, said Yang -- who came to the United States about three years ago -- had a history of depression. "Her attorney was worried about her; he thinks she has mental problems,'' she said. "She's always depressed.''
She said her sister had been introduced to a psychiatrist through her attorney and had an appointment to meet with him Friday. Former San Jose Mayor Tom McEnery remembered McCandless as a diligent, low-key businessman who worked to win over opponents. "He wasn't a person who tried to wow you with how wealthy he was or how many projects he had built," McEnery said. "He'd say, 'Here's what I want to do. Can you support it?' I'm sorry to hear what happened. He was a very good person."
