For the second time in less than three years, a research scientist at DuPont has been accused of misappropriating trade secrets from the company and attempting to use them to build competing products in China. In a lawsuit filed in Delaware Chancery Court, DuPont accused Hong Meng, a former senior research scientist at the company, of stealing data on a new, thin-computer display technology called "organic light emitting diode" or OLED. DuPont claims that Meng planned to use the stolen information to develop and commercialize products using OLED technology with his alma mater, Peking University, in Beijing, which is also developing similar technology. In a brief statement sent via email, DuPont confirmed that it filed suit against Meng for theft of trade secrets and breach of his employment agreement. Meng worked at Dupont's Central Research and Development facility in Wilmington, Del. In its complaint, DuPont described him as a Chinese citizen with permanent resident status in the U.S. The company claimed that Meng secretly accepted employment at Peking University while he was still working for DuPont. Meng's alleged theft was discovered around the time he was scheduled to be transferred to a DuPont facility in China last month. A standard review of Meng's hard drive during the transfer process disclosed an "illicit connection to Peking University," said DuPont. The company described the university as a rival because of its work involving OLED. A subsequent examination of Meng's company laptop indicated he had downloaded files related to the technology from DuPont's databases and copied them onto an external drive. . . . This is the second significant trade-secret theft involving a relatively high-level research scientist to be disclosed by DuPont in the last two and a half years. In February 2007, Gary Min, a former research scientist at DuPont admitted to stealing proprietary and information valued by federal authorities at $400 million. The theft was noticed only after Min announced plans to leave DuPont to join a rival company in the U.K. Min is currently serving an 18-month sentence in connection with the theft. DuPont: Worker Hong Meng Tried to Steal Trade Secrets

The DuPont Co. is accusing a former employee of trying to steal trade secrets and bring them back to his native China. The lawsuit was filed in late August in the Delaware Court of Chancery. It accuses Hong Meng of breach of contract and misappropriation of trade secrets. Meng allegedly was planning to bring proprietary information on a paper-thin computer display technology to his alma mater, Peking University in Beijing. DuPont Senior Vice President and General Counsel Thomas Sager said in a statement Friday that Meng was fired after an internal investigation. He says the lawsuit was filed “to ensure that he not use or disclose DuPont trade secrets.” . . . . The case is similar to a federal criminal case filed two years ago against Gary Min, who pleaded guilty to stealing trade secrets and was sentenced to 18 months in prison. DuPont charges Hong Meng industrial espionage for China

The DuPont Co. has filed a lawsuit against - and fired - a Chinese-born employee who was allegedly about to leave Delaware and return to China with company trade secrets.

This is the second time in two years that a DuPont researcher with ties to China has been involved in an alleged theft of trade secrets. The suit, filed in late August in the Delaware Court of Chancery, accuses Hong Meng of breach of contract and misappropriation of trade secrets -- specifically research into a paper-thin computer display technology called an "organic light emitting diode" or OLED. The suit alleges Meng was planning to take the proprietary information to his alma mater, Peking University in Beijing, which is involved in research on OLED technology. Meng could not be located for comment. DuPont Senior Vice President and General Counsel Thomas L. Sager issued a brief statement Friday indicating Meng, a Chinese national with permanent residency status in the United States, was fired after an internal investigation and the lawsuit was filed "to ensure that he not use or disclose DuPont trade secrets.". . . .This civil case is similar to a federal criminal case filed two years ago by the U.S. Attorney for Delaware against Gary Min for theft of DuPont trade secrets. Min, who had downloaded an estimated $400 million worth of proprietary data about some of DuPont's best-known products from a secure company database, ultimately pled guilty and was sentenced to 18 months in prison. Federal prosecutors said it was the largest criminal trade-secrets theft case ever prosecuted in Delaware. That case began with the filing of a civil lawsuit in a state court, followed by a federal criminal prosecution. Company officials would not say whether any criminal charges are likely to follow the civil case against Meng. . . . According to the lawsuit, Meng, while still employed at DuPont, secretly accepted a position at Peking University without informing DuPont or obtaining consent sometime in early 2009, in violation of the terms of an employment agreement that he signed. At the same time, Meng was scheduled to be transferred from his position in Delaware to one at DuPont's operations in China. The lawsuit did not specify where in China or which job he was to take. As part of the transfer process, Meng's hard drive was reviewed by company officials "and his illicit connection to Peking University was discovered." Furthermore, DuPont discovered that Meng had downloaded confidential company files related to OLED from his company laptop to an external hard drive. (News Journal, 7 Sep 09)
